Kinderporno op telefoon Donny M. niet onderzocht door menselijke fout
[Maastricht | maandag 29 januari 2024] Door een menselijke fout heeft de politie eenheid Limburg in 2021 de kinderporno die op de telefoon van Donny M. stond niet nader onderzocht. Voor zo’n onderzoek had een aparte opsporingszaak geregistreerd moeten worden in het computersysteem. Dit is niet gebeurd waardoor die kinderporno toen niet verder is onderzocht. Dit blijkt uit een oriënterend onderzoek van de Inspectie Justitie en Veiligheid. De politie Limburg heeft maatregelen genomen om de kans op herhaling te minimaliseren.
Donny M. wordt verdacht van het seksueel misbruiken en doden van de 9-jarige Gino in juni 2022. Zo’n anderhalf jaar daarvoor, januari 2021, had de politie zijn mobiele telefoon in beslag genomen omdat hij verdachte was bij een vuurwerkincident. Het basisteam van de politie Limburg zag er kinderporno op staan. Het droeg de telefoon daarom fysiek over aan het team bestrijding kinderpornografie en kindersekstoerisme (TBKK) dat gespecialiseerd is in de bestrijding hiervan. Dat is voorgeschreven bij strafbare feiten waarvoor specifieke kennis noodzakelijk is. Bij deze overdracht van de telefoon van basisteam naar TBBK zijn geen afspraken gemaakt over de registratie.
Het basisteam moet sowieso de zaak apart in het computersysteem registreren om ervoor te zorgen dat het TBKK de zaak in zijn werkvoorraad ziet, vervolgens oppakt en ontwikkelingen bijhoudt. Het basisteam heeft in dit geval echter geen nieuwe registratie in het computersysteem gemaakt. De kinderporno stond wel vermeld in digitale documenten over het vuurwerkincident. Ze was echter niet als ‘zelfstandige zaak’ zichtbaar in het computersysteem. TBKK kreeg daarom niets te zien in zijn digitale werkvoorraad en ging niet met de telefoon aan de slag. Nadat het basisteam zelf het vuurwerkincident had afgerond kregen alle documenten, inclusief de aantekeningen over kinderporno, de status ‘afgehandeld’. Met het vuurwerkincident verdween daarmee ook de kinderporno automatisch van de werklijsten.
De telefoon zelf lag nog bij TBKK. Die is echter aan hun aandacht ontsnapt. De politie Limburg wijt dit aan de drukke tijd waarin de telefoon binnenkwam. Het team bestaat uit zeven mensen die veel opsporingszaken behandelen. Vanwege de coronamaatregelen moesten deze specialisten ook de straat op om te zorgen dat mensen zich hielden aan de toen geldende avondklok.
Werkproces aangepast
Bij de politie-eenheid Limburg is het werkproces inmiddels aangepast om te voorkomen dat weer zo’n fout wordt gemaakt. Zonder een aparte registratie in het computersysteem kunnen gegevensdragers zoals telefoons en laptops niet aan een specialistenteam als TBKK worden overgedragen. Daarmee is volgens de politie verzekerd dat zo’n opsporingszaak te zien is in de werkvoorraad van de specialisten waardoor die ook wordt opgepakt. Die werkmethode is door Limburg gedeeld met de andere politie-eenheden.
De Inspectie JenV ziet geen reden om nog nader onderzoek te doen, temeer omdat de Limburgse eenheid het hiaat in het werkproces heeft aangepakt. Wel benadrukt ze dat het belangrijk is om ook landelijk dit proces rondom de overdracht van gegevensdragers waterdicht te maken.
Child porn on phone Donny M. not investigated due to human error
[Maastricht | Monday January 29, 2024] Due to human error, Limburg police did not further investigate child pornography on Donny M.'s phone in 2021. For such an investigation, a separate investigation case should have been registered in the computer system. This did not happen so that child pornography was not further investigated at the time. This emerged from an exploratory investigation by the Justice and Security Inspectorate. The Limburg police have taken measures to minimize the chance of recurrence.
Donny M. is suspected of sexually abusing and killing 9-year-old Gino in June 2022. About a year and a half earlier, January 2021, police had confiscated his cell phone because he was a suspect in a fireworks incident. The base team of the Limburg police saw child pornography on it. It therefore physically transferred the phone to the team combating child pornography and child sex tourism (TBKK), which specializes in combating it. This is prescribed for crimes requiring specific knowledge. In this transfer of the phone from base team to TBKK, no agreements were made about registration.
The core team must register the case separately in the computer system anyway to ensure that the TBKK sees the case in its work stock, then picks it up and keeps up with developments. In this case, however, the core team did not make a new registration in the computer system. The child pornography did appear in digital documents about the fireworks incident. However, it was not visible as an 'independent case' in the computer system. TBKK therefore did not get to see anything in its digital work file and did not engage with the phone. After the core team completed the fireworks incident itself, all documents, including the notes on child pornography, were given the status 'handled'. With the fireworks incident, the child pornography automatically disappeared from the work lists as well.
The phone itself was still with TBKK. However, it escaped their attention. The Limburg police attribute this to the busy time when the phone came in. The team consists of seven people who handle many investigative cases. Because of the coronamento measures, these specialists also had to go out on the streets to make sure that people complied with the curfew that was in effect at the time.
Work flow adjusted
At the Limburg Police Unit, the work process has now been adjusted to prevent such a mistake from happening again. Without a separate registration in the computer system, data carriers such as telephones and laptops cannot be transferred to a specialist team such as TBKK. This, according to the police, ensures that such an investigation case can be seen in the specialists' work stock so that it is also picked up. This working method has been shared by Limburg with the other police units.
Inspectorate JenV sees no reason to investigate further, especially since the Limburg unit has addressed the gap in the work process. However, she does emphasize that it is important to also make this process surrounding the transfer of data carriers watertight nationwide.
